Terms of Service

These Terms of Service ("Terms") govern your access to and use of PressPlay Studio (the "Service"), operated by Axiom Media LLC ("Axiom," "we," "us," or "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

The short version. PressPlay Studio is a platform that helps creators publish and sell audio products. Creators connect their own payment account (Stripe). When a buyer purchases, money flows directly to the creator's Stripe account — Axiom does not take or hold funds on the creator's behalf. Creators are independent businesses responsible for the content they sell, the promises they make, and the refunds they honor.

1. The Service

PressPlay Studio provides software tools that let creators:

  • Build, host, and publish marketing pages and sales funnels for audio products.
  • Collect buyer email addresses and deliver access to digital audio products and related materials.
  • Connect their own Stripe account to accept payments directly from buyers ("BYOK" — Bring Your Own Key).
  • Send transactional and marketing email via their own connected email-service-provider account (e.g., Resend).
  • Use AI-assisted tools (text drafting, audio generation, etc.) by connecting third-party AI provider keys (e.g., Anthropic, OpenAI, ElevenLabs, Google, Inworld).

2. Accounts

2.1 Eligibility

You must be at least 18 years old and legally able to enter into binding contracts to create an account. By creating an account, you represent that you meet these requirements.

2.2 Registration and security

You agree to provide accurate information when you sign up and to keep your account credentials secure. You are responsible for anything that happens under your account, whether or not you authorized it. Notify us promptly at hello@axiommedia.org if you suspect unauthorized access.

2.3 Roles

The Service has two distinct user roles, with different obligations:

  • Creators use the Service to publish and sell their own audio products to their own buyers, on terms they set.
  • Buyers purchase digital audio products from Creators using Creator-provided URLs. Buyers contract with the Creator who sold them the product, not with Axiom.

3. The platform model — payments and Creator independence

3.1 BYOK payments

Creators connect a Stripe account they own. All payment processing — card capture, charging, refunds, disputes, payouts, tax collection, currency conversion — happens between the Buyer's card issuer, Stripe, and the Creator's Stripe account. Axiom Media LLC is not the merchant of record for Creator sales. We do not hold, receive, route, or take a cut of Creator revenue.

3.2 Creator is the seller

Creators are the seller of record for their products. The Creator is solely responsible for:

  • Accurate descriptions, pricing, and claims about their products.
  • Delivering what they promise.
  • Customer support, refunds, and dispute resolution with Buyers.
  • Compliance with applicable consumer-protection, tax, advertising, export, and licensing laws in their jurisdiction and their Buyers' jurisdictions.
  • Tax collection, reporting, and remittance.
  • Honoring whatever refund and guarantee terms they publish — see our Refund Policy for the platform-level baseline.

3.3 What Axiom provides

Axiom provides the software, hosting, and integration plumbing that makes the Creator's offer work. We do not control the offer itself.

4. Acceptable use

You agree not to use the Service to:

  • Sell content or services that are illegal in your jurisdiction or the Buyer's jurisdiction, including but not limited to: child sexual abuse material; non-consensual intimate imagery; content that incites violence or unlawful discrimination; unlicensed financial-, medical-, or legal-advice products; counterfeit goods; stolen credentials or hacking services.
  • Make deceptive claims, including unsubstantiated health, financial, or earnings claims, or use fake testimonials or fabricated scarcity.
  • Resell, redistribute, or repurpose content you do not have the rights to license.
  • Send spam, run mailing-list churn schemes, or use the Service to attack, scrape, reverse-engineer, or overload third-party systems.
  • Use the Service to launder funds, evade tax, or facilitate fraud.
  • Impersonate another person or business, infringe trademarks, or misrepresent your affiliation with Axiom.
  • Circumvent platform safety mechanisms, including encryption, access controls, rate limits, or content filters.

We may suspend or terminate accounts that violate these rules. In clear cases (e.g. CSAM, ongoing fraud) we will do so without notice.

5. Your content

5.1 Ownership

You retain all ownership and copyright in the content you upload, record, generate, or publish through the Service ("Your Content"). Axiom does not claim ownership of Your Content.

5.2 License to operate the Service

To operate the Service for you, you grant Axiom a worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, transmit, display, modify (for technical purposes — e.g. format conversion, transcription), and distribute Your Content solely as needed to provide the Service to you and your Buyers. This license ends when you delete Your Content or close your account, except as needed to maintain backups for a reasonable period and to comply with legal obligations.

5.3 Buyer-purchased content

When a Buyer purchases Your Content, you grant the Buyer the license your published terms describe (e.g. lifetime personal access). Axiom is not party to that license. If the Buyer purchased through PressPlay's hosting and delivery infrastructure, we will continue to provide reasonable access to the purchased content for a commercially reasonable period, even if you later leave the platform, so we don't strand your Buyers.

5.4 AI-generated content

When you use AI-assisted tools, you are responsible for reviewing outputs for accuracy, legality, and fitness for your use case before publishing them. AI providers may use your prompts and outputs subject to their own terms; we pass calls directly to those providers using the keys you provide.

This applies with particular force to advertising and marketing assets. Ads, ad copy, landing pages, and other promotional content generated with AI-assisted tools are produced by third-party AI models and provided as-is, with no warranty as to accuracy, performance, or approval. You are solely responsible for reviewing them and for ensuring they comply with all applicable laws and with the advertising policies and terms of any platform on which you run them (including but not limited to Meta/Facebook, Google, YouTube, TikTok, and other ad networks). To the maximum extent permitted by law, Axiom Media is not liable for any action a third-party platform takes against your account — including ad rejection, account restriction, or suspension — arising from content you choose to publish or advertise.

6. Service fees

Pricing and any platform fees are listed on our website at the time you sign up or upgrade. We may change pricing on prospective billing cycles with at least 30 days' notice (sent to the email on file). If you don't agree to the new pricing, you may cancel before the next renewal.

Axiom does not charge a percentage of Creator sales (BYOK). Third- party providers you connect — Stripe, Resend, AI vendors — bill you directly under their own terms.

7. Third-party services and subprocessors

The Service relies on third-party providers to function. See our Privacy Policy for the current list and how each handles your data. Your use of a connected third-party service (Stripe, etc.) is also governed by that provider's terms.

8. Suspension and termination

8.1 By you

You may close your account at any time from your account settings, or by emailing hello@axiommedia.org. After closure we delete or anonymize personal data per our Privacy Policy, subject to legal retention requirements (e.g. tax records).

8.2 By us

We may suspend or terminate your account if (a) you breach these Terms, (b) we reasonably believe your use creates legal risk for us or other users, (c) a third-party provider (Stripe, etc.) cuts off the service you depend on, or (d) we cease to operate the Service. We will give reasonable notice where practical.

8.3 Effect

On termination your access to the Service ends. Sections that by their nature should survive — IP ownership, indemnity, liability limits, dispute resolution — do survive.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY OF DATA. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

AXIOM DOES NOT WARRANT ANY CREATOR'S PRODUCT, CLAIM, OR PROMISE. BUYERS CONTRACT DIRECTLY WITH CREATORS.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AXIOM MEDIA LLC AND ITS OFFICERS, EMPLOYEES, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE, LOST DATA, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL CUMULATIVE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF (A) THE FEES YOU PAID AXIOM IN THE 12 MONTHS BEFORE THE CLAIM AROSE OR (B) USD $100.

Some jurisdictions don't allow certain liability exclusions. In those jurisdictions our liability is limited to the smallest amount permitted by law.

11. Indemnity

You agree to indemnify and hold harmless Axiom Media LLC and its affiliates from any claim, demand, loss, or expense (including reasonable attorneys' fees) arising from (a) Your Content, (b) your sales to your Buyers, (c) your violation of these Terms, or (d) your violation of applicable law.

12. Dispute resolution

12.1 Informal first

Before filing any formal claim, please contact us at hello@axiommedia.org with a description of the dispute and the resolution you are seeking. We will attempt to resolve it in good faith for at least 30 days.

12.2 Governing law

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws principles.

12.3 Forum

Subject to Section 12.1, you and Axiom agree that any dispute will be resolved exclusively in the state or federal courts located in Delaware, and you consent to personal jurisdiction in those courts. If applicable consumer law in your jurisdiction gives you additional venue rights, those rights are not waived.

12.4 Class action waiver

You and Axiom agree to bring claims only in your individual capacity, not as a plaintiff or class member in any class or representative proceeding, to the maximum extent permitted by law.

13. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email or via the Service at least 14 days before the change takes effect, except for changes required by law which may take effect immediately. Continued use after the effective date constitutes acceptance.

14. Miscellaneous

  • Entire agreement. These Terms (with our Privacy and Refund Policies) are the entire agreement between you and Axiom regarding the Service.
  • Severability. If any provision is held unenforceable, the remaining provisions stay in effect.
  • Assignment. You may not assign these Terms without our written consent. We may assign them to an affiliate or to a successor in connection with a corporate transaction.
  • No waiver. Our failure to enforce a provision is not a waiver of our right to enforce it later.
  • Notices. We send notices to the email on file. Send notices to us at hello@axiommedia.org.
